Easement to National Grid – sub. to Permissive Referendum


NOTICE IS HEREBY GIVEN, that at a regular meeting, held on January 16, 2018 the Town Board of the Town of Van Buren duly adopted a resolution, an abstract of which follows, which resolution is subject to a permissive referendum pursuant to Article 7 of the New York State Town Law.  The full resolution and related documents are on file in the office of the Town of Van Buren Town Clerk, 7575 Van Buren Road, Baldwinsville, New York 13027 and is available for public inspection during regular business hours.


The Town of Van Buren Town Board has approved the grant of an easement over a 20-foot-wide strip of land on Town owned property located at 1299 Kingdom Road, in the Town of Van Buren (tax map parcel 038.-01-21.0).  This replaces a prior easement request from Niagara Mohawk and this new easement is needed because the exact location of the facilities has been adjusted approximately 98 feet eastward from the initial site.  The purpose of the easement is to permit Niagara Mohawk Power Corporation to construct, reconstruct, relocate, extend, repair, maintain, operate, inspect, patrol and abandon or remove electric facilities within the 20-foot-wide easement area so as to allow for the transmission and distribution of high and low voltage electric current for public or private use relative to the Town’s Solar Lease with NYRNM Project 2, LLC, a Delaware limited liability company.  As this transaction involves the conveyance of an interest in real property from the Town, it is subject to a permissive referendum.
