LAKESIDE FIRE DISTRICT RESOLUTION TO DISPOSE OF SURPLUS PROPERTY

WHEREAS: The Lakeside Fire District is anticipating the delivery of a new Pierce Rescue Pumper on or about July 2022; and

WHEREAS: Upon arrival and placing into service of the new Pierce Rescue Pumper, the Lakeside Fire District will have a new apparatus capable of performing all of the tasks currently performed by the district’s current Rescue Vehicle; and

WHEREAS: When the new Pierce Rescue Pumper is placed into service, the current Rescue Vehicle will no longer be needed by The Lakeside Fire District as the new Rescue Pumper will be able to handle all of the tasks currently performed by the current Rescue Vehicle; and

WHEREAS: The current Rescue Vehicle has been estimated to have a value of approximately Ninety-Nine Thousand Five Hundred Dollars ($99,500.00); and

WHEREAS: Once the new Rescue Pumper is placed into service the current Rescue Vehicle will no longer be needed and, as such the value of the vehicle will be diminished through the lack of use; and

WHEREAS: The Lakeside Fire District would like to sell the current Rescue Vehicle in order to recoup as much money as reasonably possible in order to defray the cost of the new Rescue Pumper or for such other expenses of the District as the Board of Fire Commissioners deems necessary provided that the current Rescue Vehicle is kept in service until the new Rescue Pumper is delivered, accepted and placed into service;

A RESOLUTION AUTHORIZING THE LAKESIDE FIRE DISTRICT TO DECLARE ITS CURRENT RESCUE VEHICLE SURPLUS WITH AN APPROXIMATE VALUE OF $99,500.00 AND TO TAKE ANY ACTIONS NECESSARY TO SELL SAID RESCUE VEHICLE FOR THE BEST COMMERCIALLY REASONABLE SUM PROVIDED THAT THE RESCUE VEHICLE THAT IS SUBJECT OF THIS RESOLUTION IS NOT SOLD OR OTHERWISE REMOVED FROM SERVICE EXCEPT FOR ROUTINE MAINTENANCE AND REPAIRS UNTIL THE NEW PIERCE RESCUE PUMPER IS PLACED INTO SERVICE AND WITH THE PROCEEDS OF THE SALE TO BE USED TO DEFRAY THE COST OF THE NEW RESCUE PUMPER OR TO BE PLACED INTO A RESERVE FUND FOR SUCH FUTURE USE AS THE BOARD OF FIRE COMMISSIONERS MAY DEEM NECESSARY.

NOW THEREFORE THE BOARD OF FIRE COMMISSIONERS OF THE LAKESIDE FIRE DISTRICT IN THE TOWNS OF GEDDES AND VAN BUREN, ONONDAGA COUNTY, NEW YORK (THE “DISTRICT”) HEREBY RESOLVES AS FOLLOWS:

SECTION 1: The District is hereby authorized to declare the current Rescue Vehicle (R-5) surplus and to sell R-5 for the best price commercially reasonably attainable.

SECTION 2: The District shall not put on the market, sell or otherwise take out of service (except for necessary routine maintenance and repairs) R-5 until such time as the new Pierce Rescue Pumper is delivered, accepted and placed into service.

SECTION 3: The District has determined that once the new Pierce Rescue Pumper is delivered and placed into service, it shall be capable of performing all of the tasks currently performed by R-5, thereby rendering R-5 surplus.

SECTION 4: The District has further determined that as a result of the delivery and placement into service of the new Pierce Rescue Pumper, R-5 will be diminished in value by the lack of use.

SECTION 5: Upon the placing of the new Pierce Rescue Pumper into service as set forth in Section 2, above, the District officers including the chairperson, are hereby authorized to take such action and execute such documents as may be necessary to put R-5 on the market including, but not limited to, listing it with a used fire/rescue apparatus dealer.

SECTION 6: Upon this resolution being adopted, the same shall be published in full in the Syracuse Post Standard, a newspaper having general circulation in the Lakeside Fire District, together with a notice from the Fire District Secretary in the form provided by Section 175 of the Town Law as amended:

SECTION 7: This Resolution is adopted subject to a permissive referendum as set forth in General Municipal Law Section 6(g)(7) and Town Law Section 176(23) as amended and will not take effect until thirty (30) days after its adoption; or until approved by the affirmative vote of a majority of the electors of the Lakeside Fire District qualified to vote at an annual election of Fire District Officers, if within thirty (30) days after the adoption of the resolution, a petition in the form and content as set forth in General Municipal Law 6(g)(7), as amended, is filed with the Fire District Secretary and said petition to be signed and acknowledged or provided in the same manner as a deed to be recorded, by resident taxpayers of the Lakeside Fire District, owning taxable real property aggregating at least one-quarter of the assessed valuation of all the taxable real property of the Lakeside Fire District as such valuations appear upon the latest completed assessment roll of the town or towns in which said fire district is located, protesting against such resolution and requesting that it be submitted to the qualified electors of the fire district affected for their approval of disapproval.
